Dependent Care and your NDPERS Flexible Spending Account

This is a reminder for NDPERS members participating in the Dependent Care Flexible Spending Account (DC FSA) – also known as FlexComp.
Some of our members may be impacted by an unforeseen discontinuation in their regular dependent care services as a result of COVID-19. If this applies to you, remember that the Internal Revenue Service (IRS) has established qualifying events that allow you to change or discontinue your contribution to your DC FSA within 31 days of the event.
If you have experienced a qualifying event and would like to update your DC FSA election with NDPERS, log in to Member Self Service (MSS) with this step-by-step guide or submit the FlexComp Change in Status (SFN 53511).
When updating your DC FSA annual election, do not enter $0 as your new annual contribution. The changes you are applying to make are only prospective. This means that any changes to your existing annual contribution must take into account the FlexComp amount deducted from your paychecks year-to-date.
If you download and complete the printable FlexComp Change in Status (SFN 53511) application, follow these tips:
- Select Option 7 – Change in cost of dependent care services or change in dependent care provider
- Submit your signed and dated application to NDPERS within 31 days of the qualifying event by mail or fax.

Once NDPERS has approved the application, we will update our records and provide notice to your employer to modify your payroll deduction.
Members that change or discontinue their DC FSA payroll deduction can apply to modify their election in the future if they experience another qualifying event such as their dependent care service restarting. It would also be considered a change in cost of dependent care services or change in dependent care provider.
